This Privacy Policy describes how Scape Studio Inc. ("we", "us", or "our"), operating as scapeid.com (the "Site"), collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

We are based in Vancouver, British Columbia, and our data practices are governed by the Personal Information Protection Act (PIPA) and the federal Personal Information Protection and Electronic Documents Act (PIPEDA).

1. COLLECTING PERSONAL INFORMATION

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. 1.1 Device Information
  • Examples of Personal Information collected: Version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Purpose of collection: To load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
  • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose: Shared with our trusted third-party processor for the purpose of fulfilling essential operational functions.
1.2 Order Information
  • Examples of Personal Information collected: Name, billing address, payment information (including credit card numbers), email address, and phone number. We also collect project-specific data including property addresses, site photos, inspiration images, and specific yard requirements provided during the "Share Your Vision" phase.
  • Purpose of collection: To provide online design services to you to fulfill our contract, to process your payment information, and to provide you with digital project deliverables, invoices, and/or order confirmations. We also use this data to communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: Collected from you.
  • Disclosure for a business purpose: Shared with our trusted payment processors (Visa, MasterCard, American Express, and PayPal) and our professional landscape designers who develop your custom plans.
1.3 Customer Support Information
  • Examples of Personal Information collected: Name, billing address, email address, and phone number.
  • Purpose of collection: To provide customer support.
  • Source of collection: Collected from you.
  • Disclosure for a business purpose: Shared with our trusted communications partners for fulfilling essential support functions.

2. MINORS

The Site is not intended for individuals under the age of 13. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

3. SHARING PERSONAL INFORMATION

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. This includes sharing property data and vision requirements with our landscape designers to create your 3D renderings and 2D plans. We may share your Personal Information to comply with applicable laws and regulations, to respond to a legal request such as a subpoena or court order, or to protect our rights, including the protection of our designs, intellectual property, and contractual agreements with clients.

4. BEHAVIOURAL ADVERTISING

We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We use Google Analytics, Facebook, Instagram, Pinterest, YouTube, Houzz, and LinkedIn to help us understand how our customers use the Site and to provide personalized design inspiration.

We share information about your use of the Site, your purchases, and your interaction with our ads on other websites with our advertising partners. We collect and share some of this information directly with our advertising partners, and in some cases through the use of cookies or other similar technologies (which you may consent to, depending on your location).

5. USING PERSONAL INFORMATION

We process your information for the following specific purposes:

  • Providing professional landscape design services through our Starter, Premium, and Luxe packages.
  • Processing payments.
  • Delivering your digital project results, including 3D renderings and 2D hardscape plans with optional add-ons including a planting plan, lighting plan, and material palette.
  • To schedule and conduct design consultation calls related to your project.
  • Send project updates, invoices, and our monthly design newsletter (where you have consented).
  • Keeping you up to date on new products, services, and offers.
  • To screen for potential fraud and protect our intellectual property.

6. LAWFUL BASIS

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • Your consent;
  • The performance of the contract between you and Scape Studio Inc. (operating as the Site);
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

7. RETENTION

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

8. AUTOMATIC DECISION-MAKING

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

We offer an optional feature called "Imagine AI" for instant plant list generation. This tool is user-activated and is not part of our standard professional design workflow.

Logic: If you use the tool, the system processes your geographic location and style preferences to recommend plant species in seconds.

Opt-Out: You have the right to ignore the automated tool and rely solely on the professional planting layouts provided as an add-on in our packages, which are manually curated by our landscape designers.

9. YOUR RIGHTS

9.1 General Rights (PIPA/PIPEDA)

You have the right to access the personal information we hold about you and request corrections if the information is inaccurate. Requests for access must be made in writing to our Privacy Officer.

9.2 GDPR (EEA Residents)

Right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.

9.3 CCPA (California Residents)

Right to access the Personal Information we hold about you (expanded beyond a 12-month lookback to include data collected since January 1, 2023), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to designate an authorized agent to submit these requests on your behalf, please contact us at the address below.

10. COOKIES

  • A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site.
  • We use a number of different cookies, including functional, performance, advertising, and social media or content cookies.
  • Cookies make your browsing experience better by allowing the website to remember your actions and preferences.
  • The length of time that a cookie remains on your computer or mobile device depends on whether it is a “persistent” or “session” cookie.
  • Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.
  • You can control and manage cookies in various ways. Please keep in mind that removing or blocking cookies can negatively impact your user experience and parts of our website may no longer be fully accessible.

11. DO NOT TRACK & GLOBAL PRIVACY CONTROL

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser. However, we recognize and honor the Global Privacy Control (GPC) signal.

If your browser transmits a GPC signal, we will automatically treat it as a request to opt-out of the "sharing" of your data for behavioral advertising.

12. SOCIAL MEDIA PORTFOLIO

We may publish completed project renderings and plans on our website or social media (Instagram, Facebook, Pinterest). We redact personal identifiers such as names and house numbers prior to publication to protect your privacy. If you prefer that your project remains private and not be used for marketing purposes, you may opt-out at any time by informing your designer or contacting us at [email protected].

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
